Distance sales agreement

1. Parties

Seller: ToolGenX is the trading name of Melike Günaydın, software engineer, a sole proprietor registered in Türkiye on 1 June 2026 (Alemdağ Tax Office, tax ID 1470465320; main activity NACE 62.10 — computer programming). Registered address: Cemil Meriç Mah. Çığır Sk. No: 27-29, İç Kapı No: 7, Ümraniye / İstanbul, Türkiye. Contact: support@toolgenx.com. Replies within 24–48 hours. The site is developed and maintained by İsmail Günaydın, software engineer.

Buyer:the person or organisation identified by the name and email address entered at checkout. The buyer’s details, the product bought, and the price paid are recorded on the order confirmation shown after payment and emailed to the buyer.

2. Subject of the agreement

This agreement covers the sale and delivery of a digital product — a template pack, prompt pack, or toolkit — selected by the buyer on toolgenx.com, and the rights and obligations of both parties under Law No. 6502 and the Regulation on Distance Contracts (Official Gazette 27 November 2014, No. 29188).

3. Product, price, and payment

• The product’s essential characteristics, file inventory, and license scope are stated on its product page at the time of purchase.
• The total price, including any applicable taxes, is shown on the product page and again at checkout before payment. There are no shipping costs — nothing physical ships.
• Payment is collected at checkout through Iyzico or Stripe hosted payment pages. Visa, Mastercard, and Amex are accepted. The seller never sees or stores full card numbers.

4. Delivery

Delivery is electronic and immediate. Once payment is confirmed, the buyer’s account is issued a license and a download link, and a confirmation email is sent to the checkout email address. There is no physical shipment and no carrier. If the download cannot be accessed, the seller fixes access or refunds in full within 30 days — see the delivery, refund & withdrawal policy.

5. Right of withdrawal

The buyer has a 14-day right of withdrawal from the date of purchase, without giving any reason, for as long as the product has not been downloaded.

Under Article 15(ğ) of the Regulation on Distance Contracts (and the parallel Article 16(m) of EU Directive 2011/83/EU), the right of withdrawal does not apply to digital content whose performance has begun with the consumer’s express prior consent. Checkout therefore shows two separate, unticked checkboxes: one requesting immediate access, one acknowledging the loss of the withdrawal right once download starts. Both are logged with timestamp, IP address, and the exact consent text, and retained for 6 years.

To withdraw, use the withdrawal button on the order in your account, or email support@toolgenx.com. Refunds are issued to the original payment method within 14 days of the withdrawal notice.

6. Seller’s obligations

• Deliver the product as described on its product page, immediately after payment.
• Provide a 30-day replacement or full refund for defective or inaccessible files, worldwide.
• Keep order, consent, and download records available to the buyer on request.

7. Buyer’s obligations

• Provide a working email address — it is the delivery address for a digital product.
• Use the product within the license granted in the terms of service: no resale, sublicensing, or redistribution of the files.

8. Complaints and disputes

Buyers in Türkiye may apply to the Tüketici Hakem Heyeti (Consumer Arbitration Committee) or the Tüketici Mahkemesi (Consumer Court) of their place of residence or of the seller, within the monetary limits announced each year by the Ministry of Trade. EU residents can use the Online Dispute Resolution platform at ec.europa.eu/consumers/odr/. Emailing support@toolgenx.com first is usually faster — most issues are resolved within 48 hours.

9. Effectiveness

This agreement takes effect when the buyer completes payment at checkout, having seen the preliminary information on the product page and confirmed the consent checkboxes. A copy of the order details is sent by email; this page constitutes the standing text of the agreement. The agreement is governed by Turkish law; mandatory consumer protections of the buyer’s country of residence remain in force.
